Subject: 9949 1993-152 Raisa Hofferman Date: Mon, 27 Feb 1989 12:20:00 -0500 Revised by Ordinance #10012 1993-152 Raisa Hofferman ORDINANCE NO. 9949 AN ORDINANCE CLOSING AND ABANDONING CALHOUN AVENUE, A 66 FOOT WIDE UNOPENED RIGHT-OF-WAY LOCATED NORTHWEST FROM EAST 44TH STREET, SOUTHWEST OF ROSSVILLE BOULEVARD; A 15 FOOT WIDE UNOPENED ALLEYWAY LOCATED NORTHWEST FROM EAST 44TH STREET, SOUTHWEST OF ROSSVILLE BOULEVARD; AND A 15 FOOT WIDE UNOPENED ALLEYWAY LOCATED NORTHWEST FROM THE ALABAMA GREAT SOUTHERN RAILROAD, SOUTHWEST OF ROSSVILLE BOULEVARD, MORE PARTICULARLY DESCRIBED HEREIN, UPON CERTAIN CONDITIONS. _______________________ SECTION 1. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That there be and is hereby closed and abandoned Calhoun Avenue, a 66 foot wide unopened right-of-way located northwest from East 44th Street, southwest of Rossville Boulevard; a 15 foot wide unopened alleyway located northwest from East 44th Street, southwest of Rossville Boulevard; and a 15 foot wide unopened alleyway located northwest from the Alabama Great Southern Railroad, southwest of Rossville Boulevard, more particularly described herein, and as shown on plat attached hereto and made a part hereof by reference: Tax Map No. 168H-K-16. 0C SECTION 2. BE IT FURTHER ORDAINED, That this closure and abandonment is made subject to the following conditions: 1. The Electric Power Board of Chattanooga has distribution facilities located within the right-of-way which must be maintained for the use and benefit of its customers and requests that the entire right-of-way be reserved as an easement for the operation; maintenance, rebuilding, and replacement of these distribution facilities. 2. The Tennessee-American Water Company requests reservation of an easement 40-feet in width (20 feet on each side of the existing 12-inch water main) for the purpose of operating and maintaining their facilities located within the right-of-way. 3. Because sewer drawings for this area are very old and inconclusive, the City of Chattanooga may have a sewer located within the right-of-way of the alley (north end) between Rossville Boulevard and Calhoun Avenue and reserves an easement for the purpose of maintaining said sewer. 4. The areas reserved for utility easements must be kept free and clear of all structures. 5. All existing easements are retained. SECTION 3. BE IT FURTHER ORDAINED, That this Ordinance shall take effect two weeks from and after its passage as provided by law.
